Terms of Use (EULA)

1. Agreement to Terms

By downloading, installing, or using PopMyVideo, you agree to these Terms of Use (End User License Agreement) and our Privacy Policy. If you do not agree, do not use the app.

PopMyVideo is published by Cats Build Ltd trading as ThinkingCats. These terms apply to the PopMyVideo mobile app on Android (com.thinkingcats.catcut) and iOS (com.thinkingcats.catcut), and to this website where relevant.

If you obtained PopMyVideo through the Apple App Store, Section 15 also applies. The App Store is not a party to this agreement.

2. Description of Service

PopMyVideo is a mobile video editing app that helps you turn raw clips into a finished cut by layering animated text, icons, shapes, visual effects, and sound effects on top of your footage — timed to the action. Your original video stays intact; polish is added as overlays, not by regenerating the video.

Features may include AI-assisted shot analysis, auto captions, motion graphics, visual effects generation, sound effects generation, and subscription plans with monthly effect allowances. We may add, change, or remove features over time.

3. Account Registration

To use AI features and subscriptions, you must create an account with a valid email address. Authentication is provided by Supabase. You agree that:

• You are responsible for all activity under your account.
• You will keep your sign-in credentials secure.
• The information you provide is accurate and up to date.

You must be at least 13 years old (or the minimum age required in your country) to use PopMyVideo. If you are under 18, you represent that you have your parent or legal guardian's permission.

4. Subscriptions & Billing

4.1 Subscription plans

PopMyVideo offers auto-renewing subscriptions, including Creator and Pro. Subscriptions provide access to premium features and a monthly AI effect allowance for the billing period shown at purchase (typically one month). The exact subscription title, length, price, and any introductory or free-trial offer are displayed in the app before you confirm purchase.

Subscription status is managed through RevenueCat. We do not receive or store your full payment card number.

4.2 Auto-renewing subscriptions (iOS — Apple App Store)

If you subscribe on iOS, the following applies:

• Payment will be charged to your Apple ID account at confirmation of purchase (or at the end of any free trial or introductory period, if applicable).
• Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription price shown in the App Store for that plan.
• You can manage subscriptions and turn off auto-renewal after purchase in Settings → Apple ID → Subscriptions on your device.
• You may not cancel the current active subscription period; cancelling stops renewal for the next period only.
• If a free trial or introductory offer is available, any unused portion will be forfeited when you purchase a subscription to that plan, where applicable.

4.3 Auto-renewing subscriptions (Android — Google Play)

If you subscribe on Android, the following applies:

• Payment will be charged to your Google Play account at confirmation of purchase (or at the end of any free trial or introductory period, if applicable).
• Your subscription automatically renews unless you cancel at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription price shown in Google Play for that plan.
• You can manage subscriptions and turn off auto-renewal after purchase in Google Play → Subscriptions.
• You may not cancel the current active subscription period; cancelling stops renewal for the next period only.
• If a free trial or introductory offer is available, any unused portion will be forfeited when you purchase a subscription to that plan, where applicable.

4.4 Cancellations, refunds, and account deletion

Cancel anytime in Google Play → Subscriptions (Android) or Settings → Apple ID → Subscriptions (iOS). Deleting your PopMyVideo account does not cancel store billing — cancel in the store first if needed.

Refunds are handled by Google or Apple under their respective policies. We do not control third-party refund decisions.

5. Acceptable Use

You may use PopMyVideo for lawful personal or commercial video editing. You may not:

• Upload or process content you do not have the right to use.
• Use the app to create unlawful, defamatory, harassing, hateful, or fraudulent content.
• Attempt to reverse-engineer, decompile, or extract source code from the app.
• Circumvent usage limits, quotas, or subscription restrictions.
• Use automated scripts or bots to access the service outside official APIs.
• Generate synthetic media depicting a real, identifiable person without their explicit consent.
• Interfere with the security or operation of the app or our servers.

We may suspend or terminate accounts that violate these rules.

6. Your Content & Intellectual Property

6.1 Your videos and projects

You retain ownership of video clips, projects, and exports you create. By using AI features, you grant us a limited licence to process the portions of your content needed to deliver those features (e.g. sending frames to our Intelligence API). We do not claim ownership of your footage.

6.2 App and technology

PopMyVideo, its logo, software, prompts, models, and platform assets are the intellectual property of ThinkingCats. These Terms do not transfer any ownership of the app to you.

6.3 AI-generated effects

Visual and sound effects generated by AI are provided for use in your edits. You are responsible for reviewing outputs before publishing and ensuring your use does not infringe third-party rights. We do not warrant that AI outputs are original, error-free, or eligible for copyright protection.

6.4 Copyright complaints

If you believe content processed through the app infringes your copyright, contact support@thinkingcats.com with a description of the work, the infringing material, and your contact information. We will respond to valid notices as required by law.

7. AI Features Disclaimer

AI analysis and generation may produce inaccurate, incomplete, or unexpected results. Outputs are provided as is without warranties of accuracy, fitness for a particular purpose, or non-infringement. You are solely responsible for content you export and publish.

8. Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the app, you consent to those practices.

9. Account Termination

You may delete your account at any time in the app: Account → Delete account & data. This removes your account and associated server data as described in the Privacy Policy.

We may suspend or terminate your access if you breach these Terms, abuse the service, or as required by law. Sections that by nature should survive (disclaimers, limitation of liability, indemnification) survive termination.

10. Disclaimers

The app and all features are provided on an as is and as available basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

We do not guarantee uninterrupted, error-free, or secure operation. Local projects on your device are your responsibility; uninstalling the app may remove local data.

11. Limitation of Liability

To the fullest extent permitted by law, ThinkingCats shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use PopMyVideo, even if we have been advised of the possibility.

12. Indemnification

You agree to indemnify and hold ThinkingCats harmless from claims, damages, and expenses (including reasonable legal fees) arising from your use of the app, your content, or your violation of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. We will post the revised version with a new "Last updated" date. Continued use of the app after changes constitutes acceptance of the updated Terms.

15. Apple App Store — Licensed Application Terms

The following terms apply if you downloaded PopMyVideo from the Apple App Store. They supplement Sections 1–14 and are required under Apple’s Licensed Application End User License Agreement.

• Parties: This End User License Agreement is between you and Cats Build Ltd only, not Apple. Cats Build Ltd is solely responsible for PopMyVideo and its content.
• Scope of license: You receive a non-transferable licence to use PopMyVideo on Apple-branded devices you own or control, as permitted by the Apple Media Services Terms and Conditions and Usage Rules, including access via Family Sharing or volume purchasing where applicable.
• Maintenance and support: Cats Build Ltd is solely responsible for maintenance and support. Apple has no obligation to provide maintenance or support for PopMyVideo.
• Warranty: If PopMyVideo fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price for the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to PopMyVideo, and any other claims, losses, or damages are the sole responsibility of Cats Build Ltd.
• Product claims: Cats Build Ltd, not Apple, is responsible for addressing any claims relating to PopMyVideo or your possession or use of it, including product liability, legal or regulatory non-conformance, and consumer protection claims.
• Intellectual property: If a third party claims that PopMyVideo infringes their intellectual property rights, Cats Build Ltd, not Apple, is solely responsible for investigation, defence, settlement, and discharge of such claims.
• Legal compliance: You represent that you are not located in a country subject to a U.S. Government embargo or designated as supporting terrorism, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Third-party terms: You must comply with applicable third-party terms when using PopMyVideo (for example, your wireless data service agreement).
• Third-party beneficiary: Apple and Apple’s subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of these terms, Apple will have the right to enforce this EULA against you as a third-party beneficiary.
